Legal basis and governing principles
- Republic Act No. 7842 established the Taguig-Pateros District Hospital under the administration and supervision of the DOH.
- Republic Act No. 7160 (the Local Government Code of 1991) requires LGUs to exercise powers and discharge functions necessary, appropriate, or incidental to efficient and effective provision of basic services and facilities, including health services such as secondary and tertiary hospitals.
- The President is empowered to reorganize offices under the executive department.
- Devolution is carried out as an exercise of the President’s authority to reorganize administration and supervision of the hospital.
Devolution of hospital administration
- The administration and supervision of the Taguig-Pateros District Hospital are devolved from the Department of Health to the City of Taguig under Section 1.
- After devolution, the City of Taguig becomes the entity responsible for administering and supervising the hospital.
- The devolution is expressly directed by Section 1 to shift both administration and supervision, not only one function.
Repeal and modification of inconsistent issuances
- Section 2 repeals or modifies all laws, issuances, rules and regulations that are inconsistent with Executive Order No. 567.
- Inconsistencies are resolved by repeal or modification accordingly, depending on the nature of the conflict with the order.
- Section 2 applies broadly to any legal or regulatory issuance that would contradict the devolution directed by Section 1.
