Retained Powers by the HLRB

  • HLRB retains all powers and functions not explicitly devolved to local government units by this Order or existing laws.

Enforcement Officers and Monitoring

  • Local chief executives must appoint qualified enforcement officers to:
    • Monitor, investigate, and enforce compliance with devolved national laws and standards.
    • Upon request, these officers may undertake preliminary investigations and issue notices to enforce HLRB mandates.
    • Enforcement officers operate under HLRB functional supervision, following guidelines and procedures set by HLRB.

Procedure for Handling Applications and Corrections

  • If HLRB discovers errors or oversight by local governments in issuing permits, it shall suspend and return applications with advisories within 30 days.
  • This process ensures local governments can rectify mistakes before final approval.

Transition Rules Upon Effectivity

  • Upon this Order’s effectivity:
    • HLRB ceases accepting new subdivision approval applications (except as noted).
    • Cities and municipalities start accepting and processing new applications.
    • If local governments fail or delay in assuming functions, HLRB continues processing until the local government signals readiness by resolution.
    • A transition period of at least 30 days is required for orderly transfer of records and responsibilities.
    • Active applications in HLRB files shall be transferred to local governments unless delays in assumption exist.

Technical and Legal Assistance

  • HLRB is mandated to provide technical and legal support and training to local governments requesting assistance.

Validity and Severability

  • If any provision of this Order is invalidated by court, remaining provisions continue in full force.

Supersession and Effectivity

  • This Order supersedes conflicting Orders and takes effect immediately upon publication in two newspapers of general circulation.
