Executive Order No. 311 designates the Office for Transportation Security as the sole authority responsible for enhancing the security of the country's transportation systems, expanding its powers to implement comprehensive security measures across civil aviation, maritime, and land transport sectors.

Powers and Functions of the Office for Transportation Security

  • Assumes the functions of the National Civil Aviation Security Committee (NCASC) and others as per Executive Order No. 277.
  • Exercises operational control and supervision over law enforcement units and personnel providing transportation security (excluding motor vehicles in land transport).
  • Responsible for security operations including screening of passengers, baggage, and cargo, and management of security personnel.
  • Develops and implements comprehensive security plans, policies, strategies, and programs for all modes of transportation.
  • Conducts performance audits of security personnel, equipment, and facilities, and sets continuous performance standards.
  • Prepares security manuals and master plans prescribing operational rules and security screening standards.
  • Establishes safety and security standards consistent with national and international laws and conventions.
  • Issues and amends Transportation Security Regulations upon approval by the Secretary of the Department of Transportation and Communications (DOTC).
  • Coordinates with other government agencies for support and resource sharing in fulfilling its mandate.
  • Actively coordinates with law enforcement for investigation and prosecution of unlawful acts affecting transportation security.
  • Performs additional functions as directed by the Secretary of the DOTC.

National Civil Aviation Security Committee (NCASC) Secretariat

  • NCASC acts as advisory and consultative body on civil aviation security to the Secretary of the DOTC.
  • NCASC is transferred from the Department of the Interior and Local Government to the DOTC and reconstituted with representatives from key government agencies and airport authorities.
  • OTS serves as the Secretariat of NCASC, with an option for qualified personnel from DILG to transfer and be absorbed by OTS.

Creation of Other Security Committees

  • The Secretary of DOTC is empowered to create additional security committees involving relevant government agencies and stakeholders.
  • These committees assist in formulating and implementing national security programs for sea transport, maritime infrastructure, land transportation, and rail systems.

Funding

  • Initial operational funds for OTS are chargeable against existing government allocations and other sources as recommended by the Department of Budget and Management.
  • Subsequent funding for OTS is included in the budget of the DOTC.

Implementing Rules and Regulations

  • OTS must promulgate necessary implementing rules and regulations within ninety (90) days from the executive order’s effectivity.
  • Rules and regulations require approval by the Secretary of DOTC.

Repeal and Modification

  • Executive Order No. 277 dated January 30, 2004, is modified accordingly.
  • All inconsistent orders, rules, regulations, or issuances are repealed or modified.

Effectivity

  • The Executive Order takes effect immediately upon signing.
