Administration of Irrigation Systems
- Irrigation systems constructed under Act No. 2152, as amended, shall be administered according to rules and regulations prepared by the Director of Public Works and approved by the President.
Delinquent Irrigation Fee Payment Relief
- Landowners delinquent on irrigation fees for all years prior to 1936 are granted until December 31, 1938, to pay their fees without interest or penalties.
- Operation and maintenance charges, with interest, and insurance charges for the years 1936, 1937, and 1938 must be paid by August 31 of the following year, as required by existing law.
Suspension of Judicial Proceedings
- All cases pending in courts for the collection of irrigation fees for years before 1936 are suspended until January 1, 1939.
- There is no prejudice to reinstating these cases after January 1, 1939, for any unpaid fees.
Repurchase of Government-Owned Lands
- Owners of lands forfeited or purchased by the government through judicial proceedings for nonpayment of irrigation fees may file applications to repurchase such lands.
- The deadline for filing repurchase applications is August 23, 1938.
- Repurchase conditions follow Executive Order No. 108, dated August 24, 1937.
Components of Adjusted Irrigation Fees Effective January 1, 1939
- Operation and maintenance costs with an interest rate of 4%.
- Insurance charge fixed at 0.50 pesos per hectare.
- Construction charge not exceeding 5 pesos per hectare.
- Total annual charges per hectare shall not exceed 8 pesos.
- The San Miguel System in Tarlac Province is excepted from these fee adjustments.
Payment Procedures and Penalties
- Irrigation fees for any year are due and payable by August 31 of the following year.
- Late payments incur a penalty of 10% additional up to December 31, and 20% thereafter, as prescribed by existing law.
- Landowners delinquent for one year or more are subject to court action under Section 13 of Act No. 2152, as amended.
Effective Date
- These regulations take effect on July 1, 1938.
