Legal basis and request from COMELEC
- The President issues the proclamation “by virtue of the powers vested…by law.”
- Commission on Elections Resolution No. 9083 requests the President to declare October 26 and 27 as special non-working holidays in barangays where the elections have not yet been held.
Policy and purpose of the holiday
- The proclamation exists because Typhoon “Ajuana” delayed delivery of election paraphernalia and made schools unavailable for voting due to evacuation occupancy.
- The proclamation provides that voters in affected barangays receive the fullest opportunity to participate in elections and exercise the right to vote.
- The proclamation states that one more day is enough to hold the special Sangguniang Kabataan Elections in the affected barangays.

- Section 1 declares Wednesday, October 27, 2010 as a Special (non-working) Holiday in 2,418 barangays.
