Republic Act No. 9849 declares the tenth day of Zhul Hijja as a national holiday for the observance of Eidul Adha, amending the Administrative Code of 1987, and repealing any inconsistent laws regarding national nonworking holidays.

Amendment to the Administrative Code on Holidays

  • Section 26, Chapter 7, Book I of Executive Order No. 292 (The Administrative Code of 1987) is amended.
  • Regular holidays now include Aidul Adha as a movable date, alongside New Year’s Day, Maundy Thursday, Good Friday, Eidul Fitr, and others.
  • Nationwide special holidays include Ninoy Aquino Day, All Saints Day, and Last Day of the Year.
  • Special rules govern holiday observance: if the holiday falls on Wednesday, it is observed on Monday of that week; if on Sunday, it is observed on the following Monday.
  • For movable holidays, the President shall issue a proclamation at least six months prior to declare the specific date a nonworking day.

Supervision and Implementation

  • The Office on Muslim Affairs (OMA) is tasked with supervising the implementation of the Act.
  • OMA is authorized to promulgate rules and regulations necessary to carry out the provisions of the law.

Repeal and Modification of Conflicting Laws

  • Any prior laws, decrees, executive orders, issuances, rules, or regulations inconsistent with this Act’s provisions on national nonworking holidays are repealed or modified accordingly.

Effectivity of the Law

  • The law takes effect fifteen (15) days after its complete publication.
  • Publication must be in the Official Gazette or at least two national newspapers of general circulation.
