Republic Act No. 4695 created four provinces in the Philippines - Benguet, Mountain Province, Ifugao, and Kalinga-Apayao - with their respective municipalities and provincial capitals, and outlined the transition process for provincial officers and employees, as well as the division of assets and representation in the House of Representatives.

Creation of provinces by division

  • Section 1 divides Mountain Province into four provinces known as Benguet, Mountain Province, Ifugao, and Kalinga-Apayao.
  • Each created province is treated as a distinct province under the Act’s framework (Section 1).
  • The territorial composition of each province is determined by the specific areas enumerated in Sections 2 to 5.

Benguet: territorial coverage

  • Section 2 provides that the Province of Benguet shall comprise the Subprovince of Benguet and the municipalities of Tuba, Sablan, Itogon, La Trinidad, Tublay, Atok, Bokod, Kabayan, Kapangan, Bakun, Kibungan, Mankayan and Buguias.
  • The Act identifies La Trinidad as the Provincial Capital of Benguet (Section 6).
  • Benguet is governed under the general rules for regular provinces, subject to the Act’s exceptions (Section 7).

Mountain Province: territorial coverage

  • Section 3 provides that Mountain Province shall comprise the Subprovince of Bontoc and the municipalities of Barlig, Bauko, Besao, Bontoc, Natonin, Sabangan, Sadanga, Sagada, Tadian and Paracales.
  • Section 6 identifies Bontoc as the Provincial Capital of Mountain Province.
  • Mountain Province is governed under the general rules for regular provinces, subject to the Act’s exceptions (Section 7).

Ifugao: territorial coverage

  • Section 4 provides that the Province of Ifugao shall comprise the Subprovince of Ifugao and the municipalities of Banaue, Lagave, Hungduan, Kiangan, Lamut, Mayaoyao and Potia.
  • Section 6 identifies Lagawe as the Provincial Capital of Ifugao.
  • Ifugao is governed under the general rules for regular provinces, subject to the Act’s exceptions (Section 7).

Kalinga-Apayao: territorial coverage and retained subprovinces

  • Section 5 provides that the Province of Kalinga-Apayao shall comprise the Subprovinces of Kalinga and Apayao.
  • Section 5 provides that the municipalities of Balbalan, Lubuagan, Pinukpuk, Tabuk, Tanudan, Tinglayan, Quirino and Liwan in the Subprovince of Kalinga shall retain its status as the Subprovince of Kalinga.
  • Section 5 provides that the municipalities of Luna, Flora, Kabugao, Pudtol, Conner and Bayag in the Subprovince of Apayao shall retain its status as the Subprovince of Apayao.
  • Section 6 identifies Tabuk as the Provincial Capital of Kalinga-Apayao.

Applicability to regular provinces

  • Section 7 requires that all provisions of law applicable to regular provinces shall apply to Benguet, Mountain Province, Ifugao, and Kalinga-Apayao, except as otherwise provided in the Act.
  • The Act thus incorporates the existing legal regime for regular provinces into each created province (Section 7).

Continuity of provincial elective officers

  • Section 8 directs that the present elective provincial officers of Mountain Province shall be assigned to and shall perform their duties in the corresponding province created, to which they belong as a member of the particular tribe or ethnic group inhabiting that province.
  • Section 8 provides that these elective officers shall continue to receive the salaries they receive at the time of approval of this Act until a new readjustment of salaries under existing law.
  • Section 8 provides a succession rule for newly created provinces: when the position of provincial governor becomes vacant because of the division, and the incumbent vice governor is assigned to that province, the law of succession applies and the vice governor automatically succeeds to governor.
  • Section 8 provides the tenure limit: the vice governor holds office as such until his successor has been elected in the election following approval of this Act and has qualified.
  • Section 8 provides that other elective officers necessary for each province shall be appointed by the President of the Philippines with the consent of the Commission on Appointments, and shall hold office until successors are elected in the election for provincial and municipal officials following approval of this Act and have qualified.

Assignment of appointive officers and employees

  • Section 9 requires that the present appointive provincial officers and employees of Mountain Province perform their duties in the province created, in which they individually choose.
  • Section 9 sets a deadline for choice: appointive officers and employees must choose within thirty days from the date of approval hereof.
  • Section 9 provides that such appointive officers and employees shall continue to receive the salaries they receive at the time of approval of this Act until the new readjustment of salaries under existing law.
  • Section 9 directs that personnel necessary to organize or complete the government personnel of any province shall be appointed as provided by law.

Representation in the House of Representatives

  • Section 10 provides that the incumbent Members of the House of Representatives shall continue serving the districts in which they were elected until their terms expire.
  • Section 10 provides that after terms expire, each province shall be represented by one Member.
  • Section 10 provides a special rule for representation: the City of Baguio shall form part of the representative district of the Province of Benguet.

Equitable division of assets and obligations

  • Section 11 requires that upon effectivity of the Act, the obligations, funds, assets and other properties of Mountain Province shall be divided equitably among Benguet, Mountain Province, Ifugao and Kalinga-Apayao.
  • Section 11 assigns the division to the President of the Philippines, upon the recommendation of the Auditor General.

Effectivity rule

  • Section 12 states that the Act takes effect upon its approval.
