Creation of Municipality of Lumbayanague

The decree is anchored on the government’s objective to provide “every opportunity and facility” to hasten socio-economic development, especially in areas comprising Muslim Mindanao.
The decree is issued to maximize the efficiency of law and order and to expedite optimum development in the affected area.
The decree is issued to ensure effective implementation of the government’s declared programs through closer supervision by local officials.
The decree is issued to uplift the political, social, and economic well-being of residents by intensifying government projects and enabling the new municipality to become a self-reliant community.

Section 1 creates the Municipality of Lumbayanague in the province of Lanao del Sur as a “distinct and independent municipality.”
Section 1 separates the following barangays from the Municipality of Lumbatan and constitutes them into the new municipality:
- Bacayawan I, Bacayawan II, Bago-ingud, Balaigay, Cadingilan, Casalayan, Dalauan Occidental, Dalauan Oriental, Lamin, Lower Diromoyod, Lumbac, Lumbayanague (Kabasaran), Miniros, Managun, Pimbago, Pitatanglan, Pcctan, Raya, Singcara, Upper Dilromoyod, Wago, West Balaygay, Punung, Ayong, Pendolonan, Kabuntongan, Dilimbayan, Sultan Village, Saloloy and Binog.
Section 1 separates the following barangays from the Municipality of Butig and constitutes them into the new municipality:
- Bualan, Mapantao-Balangas, Pagalonagan and Pantaon.
Section 1 makes the municipality created in Lanao del Sur the effective local government unit for the listed barangays.

Section 2 provides that the seat of government of the newly created municipality shall be in Barangay Lumbayanague.

Section 3 mandates that, except as otherwise provided in the decree, all provisions of law applicable to regular municipalities shall apply to the new municipality of Lumbayanague.

Section 4 provides that the present elective officials of the Municipality of Lumbatan shall perform their duties in the newly created municipality until newly appointed officials are made.
Section 4 provides that officials appointed by the President shall hold office until their successors are elected in the election for provincial and municipal officials following issuance of the decree.
Section 4 provides that appointees shall qualify and shall remain in office unless removed at the pleasure of the President.
Section 4 authorizes appointment of necessary appointive officers and employees to organize or complete the municipal government personnel of Lumbayanague under existing laws.

Section 5 provides that upon effectivity, the proportionate share of Lumbayanague in the obligations, funds, assets and other property of the municipalities of Lumbatan and Butig shall be transferred.
Section 5 directs that the transfer shall be made by the President.
Section 5 requires that the transfer be made upon the recommendation of the Commission on Audit.

Section 6 repeals or modifies all laws or parts of laws, and all executive orders or regulations, inconsistent with Presidential Decree No. 1091.
Section 7 states that the decree takes effect immediately.
