Executive Order No. 269 establishes the Commission on Information and Communications Technology (ICT) in the Philippines to promote and regulate the development of ICT systems and communication facilities, ensuring universal access, high-speed connectivity, and the protection of intellectual property rights.

Definition of ICT

  • Encompasses electronic means to collect, store, process, and present information
  • Includes computer systems, network infrastructures like telephone systems, Internet, fax machines, and others

Composition of the Commission

  • Composed of National Computer Center (NCC), Telecommunications Office (TELOF), and certain units from the Department of Transportation and Communications
  • Includes the National Telecommunications Commission (NTC) and Philippine Postal Corporation (PPC) as attached agencies
  • Headed by a Chairman with Cabinet rank, assisted by the NCC Director-General and TELOF Chief, and additional Commissioners

Powers and Functions

  • Formulate and recommend national ICT policies and guidelines
  • Harmonize and coordinate ICT plans aligned with national goals
  • Establish and manage integrated ICT programs at all government levels
  • Develop integrated government information and communications infrastructure
  • Manage and prioritize e-government systems and oversee the e-Government Fund
  • Coordinate resource generation for ICT industry development
  • Set standards for government ICT application and personnel qualifications
  • Facilitate private sector funding of government ICT projects
  • Guide government research and development in ICT
  • Regulate operation and maintenance of ICT facilities and the nationwide postal system
  • Administer and enforce ICT laws and standards
  • Protect intellectual property rights in ICT
  • Ensure consumer rights, privacy, and security
  • Coordinate e-commerce policies
  • Support trade, investment, and strategic ICT industry partnerships
  • Promote ICT education and competitiveness of the workforce
  • Exercise additional powers as needed or assigned by the President

Agency Responsibilities

  • NCC coordinates all e-government initiatives
  • TELOF supports information infrastructure development
  • Consolidates certain units under the Commission Chairman
  • Coordinates with NTC and PPC in compliant roles
  • NTC’s quasi-judicial functions remain independent

Organizational Structure

  • The Commission must submit an organizational structure and staffing pattern within 60 days for approval by the Office of the President

Performance Evaluation

  • Chairman to establish a system for periodic and objective performance evaluation
  • Annual report to be submitted to the President

Implementing Rules and Regulations

  • Chairman to issue necessary rules and regulations within 60 days to ensure effective implementation

Funding

  • Allocated funds for Commission operations subject to existing accounting and auditing regulations

Transitory Provisions

  • Transfer of NCC, TELOF, and relevant units from DOTC to the Commission
  • Preservation of employee seniority, rank, and compensation despite transfer

Repealing Clause

  • Repeals or amends inconsistent presidential acts, orders, and regulations

Effectivity

  • The executive order takes immediate effect upon issuance
