Authority and legal basis
- Presidential Decree No. 1011 is issued by the President of the Philippines by virtue of powers vested by the Constitution (preamble).
- The decree operates as part of the laws of the land (preamble).
Policy and purpose statements
- The decree advances the policy that self-reliant communities are necessary in line with intensified governmental development projects to hasten economic development (preamble).
- The decree links creation of the locality to the need for close supervision through a well-equipped administrative machinery to execute developmental programs (preamble).
- The decree frames the creation of an independent municipality as contributing to the pacification drive in the area (preamble).
- The decree bases the creation on the clamor of residents to uplift their socio-economic well-being (preamble).
Municipality created; barangays; seat of government
- Section 1 detaches and separates the following barangays from the Municipality of Upi, Province of Maguindanao, to form a distinct and independent municipality: Looy, Bongo, Biarong, Lamud, Kigan, Pandan, Romongaob, Basak (Upi side), Pilar, San Jose and Itaw.
- Section 1 creates the new municipality to be known as the Municipality of South Upi.
- Section 1 creates the Municipality of South Upi without affecting the legal existence of the mother municipality of Upi.
- Section 1 fixes the seat of government of the Municipality of South Upi in Barangay Looy.
Applicability of municipal laws
- Section 2 provides that all provisions of law, now or later applicable to regular municipalities, apply to the Municipality of South Upi.
- Section 2 establishes continuity of legal treatment for South Upi as a regular municipality except as otherwise provided in the decree.
Continuity of officials and staffing
- Section 3 directs that the present elective municipal officials of the Municipality of Upi continue to perform their duties in the Municipality of South Upi.
- Section 3 provides that officials in the newly created municipality who are required to be appointed shall be appointed by the President.
- Section 3 states that the appointed officials shall hold office until their successors shall have been elected in the regular elections for municipal officials following issuance of the decree and shall have qualified, unless removed earlier at the pleasure of the President.
- Section 3 requires that necessary appointive officers and employees to organize and complete the government personnel of the Municipality of South Upi shall be appointed as provided under existing laws.
Transfer of obligations, funds, assets, property
- Section 4 provides that, upon effectivity of the decree, South Upi’s proportionate share in the obligations, funds, assets, and other property of the Municipality of Upi shall be transferred.
- Section 4 requires the transfer to be done by the President.
- Section 4 requires the transfer to be made upon the recommendation of the Commission on Audit.
Repeal and conflict rule
- Section 5 repeals and/or modifies all laws or parts of laws, and all executive orders and regulations, inconsistent with Presidential Decree No. 1011.
- Section 5 applies the repeal/modification rule to the extent of inconsistency.
