Policy and basis for creation
- The decree declares that accelerating the country’s socio-economic development is a basic government objective.
- The decree recognizes that the barangay is the smallest political unit of government and functions as an effective instrument through faster administrative response and delivery of the eleven basic needs of the people.
- The decree states that residents of the proposed barangay, in sufficient number and occupying an adequate area, led by natural community leaders, clamored for creation to ensure closer supervision of local developmental programs and attainment of community self-reliance.
- The President acts by virtue of powers vested under the Constitution to “order and decree” the barangay creation (preamble).
Barangay territory and detachment
- Section 1 detaches from Barangay Culiat in Quezon City, Metro Manila a specific territorial portion and forms it into a new barangay.
- The detached area is bounded on the North and Northeast by Tandang Sora.
- The detached area is bounded on the East by Tandang Sora Avenue.
- The detached area is bounded on the Southeast by Don Mariano Marcos avenue and on the South by Central Avenue.
- The detached area is bounded on the Southeast by Sitio Mabilog and Milton Hills Subdivision.
- The detached area is bounded on the West by Lots Nos. 689, 680, 678 and 687 of the Piedad Estate and by San Antonio Subdivision.
- The detached area excludes property belonging to or occupied by: Claretian Order, Philippine Assembly of the First Born, and Muslin Conference of the Philippines (Section 1).
- Barangay New Era is created as a distinct and independent barangay without affecting the legal existence of the mother barangay of Culiat (Section 1).
Applicability to barangay governance
- Barangay New Era is governed by all provisions of law applicable to regular barangays, except as otherwise provided in the decree (Section 2).
- The decree makes no carve-out from general barangay law other than the specific rules stated in Sections 3 and 4 (Section 2).
Incumbent officials and appointment of officers
- The present elective barangay officials of Barangay Culiat continue to perform their duties in the newly created Barangay New Era until Barangay New Era officials are appointed by the President (Section 3).
- Appointed officials hold office until their successors are elected in the regular barangay elections following the issuance of the decree (Section 3).
- Appointive officers and officials appointed to Barangay New Era shall hold office until their successors shall have been elected and shall have qualified (Section 3).
- Appointive officers and employees may be removed at the pleasure of the President (Section 3).
- Necessary appointive officers and employees to organize Barangay New Era or complete its government personnel complement are appointed as provided for under existing laws (Section 3).
Transfer of obligations, funds, assets, and property
- Upon effectivity, the President transfers the proportionate share of Barangay New Era in the obligations, funds, assets, and other property of Barangay Culiat to the newly created Barangay New Era (Section 4).
- The transfer is made upon recommendation by the Commission on Audit (Section 4).
Repeal, modification, and immediate effect
- The decree repeals or modifies all laws or parts of laws and all executive orders or regulations that are inconsistent with it (Section 5).
- The decree takes effect immediately (Section 6).
