Authority, citation, and effectivity
- Presidential Decree No. 1321 is issued by the President of the Philippines, Ferdinand E. Marcos, exercising powers vested by the Constitution.
- The decree is dated April 03, 1978.
- Section 6 provides that the decree takes effect immediately.
- The deed of issuance is completed in the City of Manila on April 3, 1978, and is signed by Ferdinand E. Marcos as President, and by Juan C. Tuvera as Presidential Assistant.
General applicability to regular barangays
- Section 2 provides that, except as otherwise provided in the decree, all provisions of law applicable to regular barangays apply to Barangay Moonwalk.
Continuity of local officials and appointments
- Section 3 provides that the present elective barangay officials of Barangay Sto. Niào shall continue to perform their duties in Barangay Moonwalk.
- Section 3 provides that elective officials perform their duties until the barangay officials of Barangay Moonwalk are appointed by the President.
- The appointive officials shall hold office until their successors shall have been elected in the regular elections for barangay officials following issuance of the decree and shall have qualified, unless sooner removed at the pleasure of the President.
- Section 3 provides that necessary appointive officers and employees to organize or complete the government personnel of Barangay Moonwalk shall be appointed as provided under existing laws.
Transfer of obligations and assets
- Section 4 requires the transfer of Barangay Moonwalk’s proportionate share in the obligations, funds, assets, and other property of Barangay Sto. Niào.
- The transfer is to be made upon the recommendation of the Commission on Audit by the President to the newly created barangay.
Repeal or modification; immediate legal effect
- Section 5 repeals or modifies all laws, parts of laws, and all executive orders or regulations inconsistent with the decree.
- Section 6 provides immediate effect upon enactment without waiting for a publication rule or other condition.
