Legal basis and declared intent
- The President exercises power vested by the Constitution to order and decree the barangay creation in the Decree’s opening clause.
- The Decree declares the aim of the State to hasten up the pace of socio-economic development throughout the country.
- The Decree declares that effective implementation of government development programs depends on administrative efficiency of each local government unit.
- The Decree recognizes the clamor of residents and the conformity of elective officials of the locality to create a new barangay for closer supervision of local development program execution.
- The Decree declares that creating the barangay will uplift the socio-economic well-being of residents within the area.
Barangay creation and geographical coverage
- Section 1 detaches and separates BF International Village in Barangay Talon in the Municipality of Las Piñas, Metro-Manila.
- The detached area is formed into a distinct and independent barangay.
- The newly created barangay is known as Barangay BF International.
- The creation does not affect the legal existence of the mother barangay.
Application of barangay laws
- Section 2 applies all provisions of law applicable to regular barangays to Barangay BF International.
- Section 2 applies those provisions except as otherwise provided in the Decree.
Continuity of officials and appointment
- Section 3 provides that the present elective barangay officials of Barangay Talon continue performing their duties in the newly created Barangay BF International until new barangay officials are appointed by the President.
- Officials appointed by the President hold office until their successors have been elected in the regular elections for barangay officials following the issuance of the Decree.
- Appointees hold office until qualification of successors, and appointees may be removed sooner at the pleasure of the President.
- Section 3 directs that any appointive officers and employees necessary to organize or complete the barangay’s personnel are appointed as provided for under existing laws.
Transfer of shares in properties and obligations
- Section 4 requires transfer of the proportionate share of Barangay BF International in the obligations, funds, assets and other property of Barangay Talon.
- The transfer is made by the President.
- The transfer is done upon the recommendation of the Commission on Audit.
- The transfer obligation arises upon the effectivity of the Decree.
Repeal, modification, and separability
- Section 5 repeals or modifies all laws or parts of laws and all executive orders or regulations that are inconsistent with the Decree.
- Section 6 makes the Decree effective immediately upon issuance.
- The Decree is structured so that exceptions to general barangay rules are governed by Section 2’s “except as hereinafter provided” clause.
