Composition of Agusan del Norte
- Comprises the Municipalities of Carmen, Nasipit, Buenavista, Cabadbaran, Tubay, Jabonga, Kitcharao, and Las Nieves.
- A specific portion of the Municipality of Esperanza is reassigned to the Municipality of Las Nieves in Agusan del Norte, defined by precise geographic coordinates and boundary descriptions.
Composition of Agusan del Sur
- Comprises the Municipalities of Bayugan, Esperanza, Prosperidad, San Francisco, Bunawan, Talacogon, La Paz, Loreto, Veruela, and Santa Josefa.
Capitals of the New Provinces
- The capital of Agusan del Norte is designated as Butuan City.
- The capital of Agusan del Sur is designated as the Municipality of Prosperidad.
Applicable Laws
- All existing and future provisions applicable to regular provinces are also applicable to Agusan del Norte and Agusan del Sur, except as otherwise provided in the Act.
Plebiscite and Effectivity of Division
- The division shall become effective only upon approval by majority vote of the voters of the original Province of Agusan in a plebiscite held simultaneously with the November 1967 elections, supervised by the Commission on Elections.
- If approved, the new provinces shall be organized upon the special elections for provincial officials and members of the House of Representatives scheduled for November 1969.
- Specially elected provincial officials in 1969 will serve until successors are elected and qualified in the next local elections.
- Officials elected for the original Province of Agusan in 1967 will continue their terms as officials of Agusan del Norte until successors qualify.
Election Canvassing
- The Provincial Board of Canvassers of Agusan shall canvass the votes cast in the 1969 special elections for provincial officials of Agusan del Sur according to the Revised Election Code.
Distribution of Assets and Liabilities
- Upon organization, the obligations, funds, assets, and other properties of the original Province of Agusan shall be equally divided between Agusan del Norte and Agusan del Sur.
- This division will be executed by the President of the Philippines upon the recommendation of the Auditor General.
Effectivity Clause
- The Act takes effect immediately upon approval.
- The Act was enacted without the Executive's approval on June 17, 1967.
