Court branches created and where they sit
- Section 1 creates two (2) additional Regional Trial Court branches in the Sixth Judicial Region for the Province of Negros Occidental.
- One branch is to be stationed at the City of La Carlota.
- The other branch is to be stationed at the City of Bago.
- The Supreme Court must assign the branch numbers of the newly created RTC branches in the Sixth Judicial Region.
Supreme Court coordination and operationalization
- Section 2 directs the Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, to immediately include in the Court’s program the operationalization of the two (2) additional RTC branches.
- The annual General Appropriations Act must include the funding for the operation of the two additional branches.
- Funds for operation of the newly created courts must be appropriated and released only upon the actual organization of the courts and the appointment of its personnel.
Implementing rules and realignment authority
- Section 3 empowers the Supreme Court to issue the necessary rules and regulations for the effective implementation of RA No. 10250.
- Section 3 authorizes the Supreme Court, if warranted, to order the realignment of seats of existing branches.
- Section 3 further authorizes, if warranted, the realignment of territorial jurisdiction of existing branches.
Amendments, repeal of inconsistent rules
- Section 4 amends Section 14(g) of Batas Pambansa Blg. 129 (the Judiciary Reorganization Act of 1980) as amended.
- Section 4 provides that all other laws, rules and regulations inconsistent with RA No. 10250 are amended, repealed, or modified accordingly.
Appropriations and organization condition
- Section 2 requires that funding included in the annual General Appropriations Act is tied to the operationalization of the newly created branches.
- Section 2 conditions the appropriation and release of funds on actual organization of the RTC branches.
- Section 2 also conditions the release of funds on the appointment of personnel for the organized courts.
