Law Summary

Creation and Distribution of New Rank

  • The rank of First Chief Master Sergeant/First Master Chief Petty Officer (E-10) is created.
  • This rank is part of the noncommissioned grades of the AFP.
  • It shall be held exclusively by the AFP Sergeant Major.

Selection of AFP Sergeant Major

  • The AFP Sergeant Major is selected from among Chief Master Sergeants/Master Chief Petty Officers.
  • Selection rules and regulations to be prescribed by the AFP Chief of Staff.
  • The AFP Sergeant Major may serve a maximum term of three years unless earlier terminated for cause by the Chief of Staff.
  • Appointment requires the candidate to have at least one year of active service remaining before compulsory retirement age.

Compensation

  • A First Chief Master Sergeant/First Master Chief Petty Officer receives a monthly base pay equivalent to Salary Grade 19.

Retirement and Separation

  • Personnel attaining the rank of First Chief Master Sergeant/First Master Chief Petty Officer shall be retired with the rank of Second Lieutenant/Ensign.
  • Retirement pay and benefits shall correspond to the rank of First Lieutenant/Lieutenant Junior Grade (O-2).

Appropriations

  • Initial implementation funding shall come from the AFP's current appropriations under the General Appropriations Act.
  • Subsequent funding shall be included in the annual General Appropriations Act.

Implementing Rules and Regulations

  • The Secretary of National Defense must promulgate implementing rules and regulations within 90 days after the Act's approval.

Repealing Clause

  • All laws, rules, regulations, orders, circulars, and memoranda inconsistent with this Act are repealed or modified accordingly.

Effectivity

  • The Act takes effect fifteen days after its approval.
