Law Summary

Capital Cities Designation

  • The capital of Oriental Mindoro is designated as Calapan.
  • The capital of Occidental Mindoro is to be selected by at least five municipal councils from its municipalities within fifteen days following the constitution of the new province.
  • If these councils fail to designate a capital within the specified period, the President of the Philippines shall appoint the capital of Occidental Mindoro.

Application of Existing Laws

  • Both provinces shall be governed by all laws applicable to regular provinces, whether existing or enacted in the future, except where explicitly provided otherwise.

Governance of Oriental Mindoro

  • The elected provincial officers from the former Province of Mindoro will continue governing Oriental Mindoro until their successors are duly elected and qualified.
  • The provincial governor, treasurer, and fiscal of Oriental Mindoro shall maintain their current salaries until a new salary adjustment is made.

Governance of Occidental Mindoro

  • The President, with the advice and consent of the Commission on Appointments, will appoint the initial elective provincial officers of Occidental Mindoro as soon as the Act is implemented.
  • These appointed officers will serve until their successors are elected in the next general election and qualified.

Congressional Representation

  • Each new province shall have one Representative in the national legislature.
  • The current Representative for the unified Province of Mindoro shall represent Oriental Mindoro during their term.
  • That Representative will also represent Occidental Mindoro until a new Representative is elected in the next general or special election.

Distribution of Assets and Obligations

  • The properties, funds, and obligations of the original Province of Mindoro shall be equitably divided between the two new provinces.
  • The Auditor General will recommend the distribution plan which requires approval by the President.

Effectivity of the Act

  • The Act shall take effect on a date to be proclaimed by the President of the Philippines, thereby providing flexibility for its execution.
