  • Members: P800 monthly allowance; per diem up to P200 per meeting; max total P1,600/month per member.

Jurisdiction, Powers and Functions

  • Exclusive authority over the conduct of horse racing including race scheduling, racetrack safety, prize allocation, and racing security.
  • Assumes functions from the Games and Amusements Board related to horse racing, except betting supervision.
  • Games and Amusements Board retains jurisdiction over jai alai, boxing, and wrestling.

Specific Powers of the Commission

  • Enforce existing laws, decrees, and executive orders related to horse racing.
  • Prescribe additional rules consistent with the Decree.
  • Register racehorses, owners, and associations.
  • Regulate racetrack construction and grant race permits.
  • Issue, suspend, revoke permits and licenses; collect related fees.
  • Review and approve rules/regulations by other entities on horse racing.
  • Supervise race meetings to maintain integrity; suspend events for violations.
  • Prohibit improper devices, drugs, stimulants affecting horse performance.
  • Approve budgets and appoint commission personnel including an Executive Director.
  • Enter contracts and obligations chargeable to the Commission funds.

Other Powers and Duties

  • Impose fines, penalties, and forfeitures accruing to Commission funds.
  • Modify, suspend, revoke permits or licenses after notice and hearing, or temporarily suspend without hearing for good cause.
  • Conduct hearings and investigations with adopted procedural rules.
  • Allow appeals to the President within 72 hours.
  • Summon parties, subpoena documents essential to investigations.
  • Delegate members or officers to conduct hearings/investigations.
  • Perform other incidental or necessary duties to fulfill objectives.

Funding

  • Special fund constituted from 1% of gross receipts from sales of tickets on specific betting events (daily double, llave forecast, jackpot).
  • Pari-mutuel race receipts continue to fund the Games and Amusements Board separately.
  • Suspension of licensed jockeys/trainers includes temporary loss of benefits except medical/hospitalization.

Audit

  • Commission on Audit to appoint an auditor and staff to oversee Commission’s financial matters.

Applicability of Civil Service Law and Exemption from Wage and Position Classification

  • All personnel subject to Civil Service Law.
  • Regular professional/technical personnel exempt from Wage and Position Classification coverage.

Supplies and Services Procurement

  • Purchases/contracts for supplies or services done by competitive public bidding.
  • Emergency procurements exempted under specific conditions certified by Chairman.
  • Bidding not required for purchases under P10,000.
  • Emergency purchases capped at P50,000 per month.
  • Award considerations include bidder’s financial responsibility, skill, experience, integrity, compliance, and delivery time.

Transitory Provisions

  • Until PRC organization, Games and Amusements Board retains transferred functions.
  • Transfer and retention of personnel clarified; separated employees entitled to retirement or gratuity benefits.
  • PRC authorized to reorganize National Stud Farm; Farm under Commission supervision pending reorganization.

Repealing Clause

  • Inconsistent laws, decrees, orders, and regulations including Republic Act No. 309, as amended, are repealed or modified accordingly.

Separability Clause

  • If any provision declared unconstitutional, other provisions remain valid.

Effectivity

  • The Decree takes effect immediately upon promulgation.
