Presidential Decree No. 1293 establishes the Katarungan Pambarangay Commission, tasked with studying the feasibility of resolving disputes at the barangay level to alleviate docket congestion in the courts and preserve the tradition of amicably settling disputes among family and barangay members.

Composition and Leadership of the Commission

  • Chaired by the Chief Justice of the Supreme Court.
  • Members include:
    • Secretary of Justice
    • Secretary of National Defense
    • Secretary of Local Government and Community Development
    • Secretary of Education and Culture
    • President of the Integrated Bar of the Philippines
    • Director of the U.P. Law Center

Mandate and Considerations

  • Tasked to assess the feasibility of instituting a barangay-level dispute resolution system.
  • Required to consider and respect Filipino customs and traditions in its study.

Administrative Provisions and Operational Support

  • Authorized to organize a staff for technical and administrative assistance.
  • Members and Chairman are not entitled to additional compensation for their commission duties or meetings.

Reporting and Accountability

  • Required to submit a comprehensive report and recommendations to the President (or Prime Minister) by December 31, 1978.

Funding and Implementation

  • Funding to be drawn from unexpended appropriations of the Judiciary for the Commission’s operations.
  • The Decree takes immediate effect upon issuance.

Legal Effectivity

  • Signed and enacted in Manila on January 27, 1978, by President Ferdinand E. Marcos.
  • Official endorsement and promulgation by the Presidential Executive Assistant.
