Creation and Composition of the Energy Development Board
- Establishes the Energy Development Board (the Board) as a central governmental entity.
- Board composed of key cabinet secretaries: Finance, Industry, Justice, National Defense, Economic Planning, Natural Resources, and Chairman of the Philippine National Oil Company.
- The President designates the Board’s Chairman from among its members.
- Alternate members are officials next in rank who attend meetings in the absence of principal members.
Powers and Functions of the Board
- Formulates policies and coordinates government activities related to indigenous energy resources (petroleum, coal, natural gas, geothermal, nuclear, and unconventional energy).
- Establishes and manages integrated programs for energy exploration, development, and extraction.
- Can directly undertake energy resource projects or enter into service contracts.
- Regulates exploitation, development, and extraction activities, including fee collection.
- Oversees energy research and development, ensuring commercial feasibility studies.
- Assumes powers of the abolished Petroleum Board.
- Coordinates and approves the plans of the Power Development Council.
- Authors rules and regulations necessary for implementation.
- Exercises incidental powers to fulfill its objectives.
Officials and Employees of the Board
- Board appoints an Executive Director for assistance.
- Has exclusive authority to appoint officers and employees.
- Authority extends to fixing salaries, benefits, work conditions, leaves, discipline, and removal for cause.
- Establishes a merit-based recruitment and personnel system.
Abolition of the Petroleum Board
- Petroleum Board is abolished.
- Its powers, functions, personnel, funds, and assets are transferred to the Energy Development Board.
Transfer of Functions from the Bureau of Mines and Department of Natural Resources
- Transfers coal-related exploration and development powers to the Board (from Bureau of Mines/Department of Natural Resources).
- Transfers geothermal, natural gas, and methane gas regulation and promotion to the Board.
- Transfer includes records, assets, funds, and personnel.
Supervision of the Philippine National Petroleum Center
- The Philippine National Petroleum Center falls under the supervision and control of the Board.
Appropriations and Funding
- Initial appropriation of Five Million Pesos from the National Treasury for Board organization and operation.
- Annual funding for the Board is mandated through the General Appropriations Act.
- All fees, royalties, bonuses, and revenues collected from energy contracts and operations form a Special Fund.
- Special Fund used to finance government energy programs and projects.
Reporting Requirements
- Board must submit an annual report to the President within three months after fiscal year-end.
- Report includes an energy development plan on indigenous resource exploration and exploitation.
- Board must also submit periodic reports as required.
Separability Clause
- If any provision is found unconstitutional, other provisions remain unaffected.
Repealing Clause
- All laws, decrees, orders, rules or regulations inconsistent with this Decree are repealed or modified accordingly.
Effectivity
- The Decree took effect immediately upon promulgation.
