Composition and Powers of the Board of Directors
- AIDA is governed by a Board of Directors consisting of key government officials and representatives of abaca producers and traders.
- Government members include Secretaries of Agriculture, Trade, Local Governments and Community Development, Chairman of the Board of Investments, Governors of the Central and Development Banks, and President of the Philippine National Bank.
- The President appoints the producer and trader representatives for a term of three years.
- The Board elects a Vice-Chairman who acts in the Chairman's absence.
- Board members may designate alternates and receive per diems up to PHP 1,000 per month.
Organizational Structure and Management of AIDA
- The agency has the authority to create its organizational structure, including positions and salaries.
- Positions like Administrator and Deputy Administrator must be created.
- The Board appoints all officers and establishes compensation schemes.
- The Administrator manages daily operations and implements Board policies.
- Managerial and technical personnel are exempt from Civil Service and OCPC requirements.
Powers and Functions of AIDA
- Formulate and implement integrated programs and policies for industry development.
- Regulate research, production, processing, and marketing domestically and internationally.
- Establish market monitoring systems to assess supply and demand.
- Negotiate contracts for export, shipping, storage, and other operational needs.
- Maintain price schemes and stockpiles to stabilize prices benefiting farmers.
- Promote agricultural research in collaboration with relevant agencies.
- Borrow funds and issue financial instruments subject to regulatory approval.
- Recommend credit and support programs to financial institutions.
- Enter into contracts and accept donations or grants for operational funding.
- Invest funds prudently pending their use for industry development.
- Access all pertinent operational information of the industry.
Authority to Issue Implementing Rules and Regulations
- AIDA is empowered to promulgate rules and regulations necessary to carry out the decree’s provisions effectively.
Funding and Appropriations
- Unexpended funds from BFDIS and Abaca Production and Development Program appropriations for 1977-1978 are transferred to AIDA.
- AIDA may impose fees, receive grants, subsidies, donations, or contributions and retain those funds for its operations.
Separability Clause
- If any provision is declared unconstitutional, other provisions remain valid and effective.
Repealing Clause
- All laws, decrees, acts, orders, and regulations inconsistent with this decree are repealed, amended, or modified as necessary.
Effectivity
- The decree takes effect immediately upon approval, formalizing the creation and operation of AIDA.
