Conditions for the Municipality to Begin Functioning
- The municipality of Pagudpud shall legally come into existence upon the following events:
- Appointment and qualification of its mayor, vice-mayor, and a majority of the municipal councilors.
- Certification by the Secretary of Finance affirming that Pagudpud is financially capable of:
- Implementing the provisions of the Minimum Wage Law.
- Fulfilling all statutory obligations.
- Providing ordinary essential municipal services consistent with that of a regular municipality.
- Certification that the mother municipality of Bangui, after the segregation of said barrios, remains financially capable to:
- Maintain its municipal government operations creditably.
- Meet all its statutory obligations.
- Continue to provide essential municipal services.
Legal Authority and Compliance
- The separation and creation of the new municipality are pursuant to Section 68 of the Revised Administrative Code.
- The executive order reflects compliance with the administrative and financial prerequisites under Philippine law to form a viable local government unit.
Formalization and Effectivity
- The Executive Order was signed by the President of the Philippines and the Executive Secretary on February 14, 1954, in Manila.
- The establishment of Pagudpud as a municipality is bound to the fulfillment of the conditions enumerated, ensuring orderly governance and service delivery post-creation.
