Legal basis for segregation

- The boundary description incorporates the boundary of the marine waters that Lugait shall have **pursuant to Section 2321 of the Revised Administrative Code.
- The territorial description is based on a sketch plan or map prepared and submitted with specified scaling information: Scaler 1, 20,000 and a basis tied to the Bureau of Lands and the Highway District Engineer of Misamis Oriental.
Remaining territory of Manticao
- The municipality of Manticao retains the same overall territory minus the territory now comprised in the municipality of Lugait, as delimited by the order’s boundary description.
When Lugait comes into existence
- Lugait begins to exist upon appointment and qualification of the mayor, vice-mayor, and a majority of the councilors.
- Lugait’s existence is further conditioned on certification by the Secretary of Finance that the municipality is financially capable of implementing the Minimum Wage Law.
- The Secretary of Finance’s certification requires assurance that Lugait can provide all statutory obligations and ordinary essential services of a regular municipality.
- The Secretary of Finance’s certification also requires assurance that, after segregation, Manticao can still maintain creditably its municipal government, meet statutory and contractual obligations, and provide essential municipal services.
