Territorial segregation and municipal boundaries
- The barrios and sitios of Hilusig, Cuatro de Agusto, Liberacion, Himamara, Tagaytay, Hemaguimetan, Lower Mahaplag, Upper Mahaplag, Palanogan, Campin, Mabunga, Mahayag, Malinao, Union, Uigis, Mahayahay, Palahongon and Pinamono-an are segregated from the municipality of Abuyog, province of Leyte.
- The segregated barrios and sitios are organized into an independent municipality.
- Abuyog retains the same territory minus the area comprised in the municipality of Mahaplag.
Seat of government
- The seat of government of the Municipality of Mahaplag is the barrio of Mahaplag.
When the municipality begins to exist
- The municipality of Mahaplag begins to exist upon the appointment and qualification of the mayor, vice-mayor, and a majority of the councilors.
- Mahaplag begins to exist only after a certification by the Secretary of Finance is made.
- The Secretary of Finance’s certification must confirm Mahaplag’s financial capacity to:
- implement the Minimum Wage Law; and
- provide for all the statutory obligations and ordinary essential services of a regular municipality.
- The certification must also confirm that the mother municipality of Abuyog, after segregation, can still:
- maintain its municipal government credibly;
- meet all statutory and contractual obligations; and
- provide essential municipal services.
Responsible official for financial capability
- The Secretary of Finance performs the certification that controls the effective start of Mahaplag’s existence.
Transitory consequence for the mother municipality
- Abuyog remains capable of continuing its municipal government after segregation, as measured by its ability to meet statutory and contractual obligations and provide essential services.
- The segregation reduces Abuyog’s territory by the amount that forms the municipality of Mahaplag.
