Composition of the Committee
- The Secretary of Trade and Industry serves as Chairman of the Committee.
- The Secretary of Justice and the Secretary of Finance serve as Vice-Chairmen.
- The Chief Presidential Legal Counsel is a Member.
- The Director of the National Bureau of Investigation is a Member.
- The Chief of the Philippine National Police is a Member.
- The Commissioner of the Bureau of Customs is a Member, together with the following additional members:
- The Chairman of the Videogram Regulatory Board
- The Commissioner of the National Telecommunications Commission
- The Chief of the Copyright Office of the National Library
- The Director of the Bureau of Patents, Trademarks and Technology Transfer
- The Director of the Bureau of Trade Regulations and Consumer Protection
- One representative each from two major non-government organizations involved in the protection and promotion of intellectual property rights, to be determined by the Committee.
Core powers and functions
- The Committee shall recommend policies and coordinate the policy-making process in the Executive Branch on the protection and enforcement of intellectual property rights.
- The Committee shall coordinate with agencies across the Executive, Legislative, and Judicial Branches to effectively address problem areas arising from infringement and counterfeiting.
- The Committee shall enlist the assistance of any government branch, department, bureau, office, agency, instrumentality, including government-owned and controlled corporations, in the anti-piracy and counterfeiting drive, including the use of personnel, facilities, and resources for prevention, detection, investigation, and prosecution.
- The Committee shall cause and direct immediate investigation and speedy prosecution of cases involving violations of copyright, trademarks, patents and other intellectual property related laws, and intellectual property theft-related cases referred to the Committee.
- The Committee shall recommend the transfer of cases involving the laws enumerated for enforcement to ensure efficient and expeditious dispensation of criminal justice, and shall monitor for speedy resolution of cases under investigation or prosecution.
- The Committee shall refer such cases to the appropriate law enforcement agency or prosecution office for investigation or prosecution.
- The Committee shall monitor the progress of ongoing investigation and prosecution of cases taken cognizance of by the Committee.
Fast-track plans and public information
- The Committee shall prepare and implement a fast-track anti-piracy and counterfeiting plan of action.
- The Committee shall adopt strategies and measures to ensure an effective and efficient anti-piracy and counterfeiting program and promote public adherence to and compliance with domestic and international laws for the protection of intellectual property rights.
- The Committee shall coordinate with appropriate government agencies and non-government organizations to conduct an information dissemination campaign on intellectual property rights and the measures to address the issues.
Legislative recommendations and rewards
- The Committee shall recommend appropriate intellectual property rights issuances and legislation to the President and Congress.
- The Committee shall consider granting monetary rewards and incentives to informants willing to provide vital information to build cases for prosecution of criminal offenders as provided under existing laws.
- The Committee shall perform other functions necessary to pursue its objectives.
Secretariat and administrative support
- The Committee shall organize its Secretariat under the Office of the Secretary of Trade and Industry.
- The Secretariat shall be headed by an Executive Officer designated by the Chairman.
Funding and budgeting
- The Committee, upon the recommendation of the Chairman, shall be provided an initial budget determined and approved by the President.
- Appropriations for succeeding years shall be incorporated in the budget proposals under the Office of the President.
Operating guidelines and implementation
- The Committee shall adopt operating guidelines necessary to implement Executive Order No. 60.
Effectivity
- Executive Order No. 60 takes effect immediately.
- It was done in the City of Manila on February 26, 1993 and signed by Fidel V. Ramos (President of the Philippines), with Antonio T. Carpio as Chief Presidential Legal Counsel by the President.
