Creation of the additional RTC branch
- Section 1 creates an additional Regional Trial Court branch in the Sixth Judicial Region.
- The newly created RTC branch has its seat at the City of Sagay, Province of Negros Occidental.
- The Supreme Court assigns the branch number of the newly created RTC branch in the Sixth Judicial Region.
Operationalization and funding process
- Section 2 directs the Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, to immediately include the operationalization of the additional RTC branch in the Court’s program.
- The annual funding for the operationalization of the new branch must be included in the annual General Appropriations Act.
- Funds for the operation of the newly created court shall be appropriated and released only upon the actual organization of the court and the appointment of its personnel.
Amendment, repeal, and modification of inconsistent laws
- Section 3 amends Section 14(g) of Batas Pambansa Blg. 129, otherwise known as the Judiciary Reorganization Act of 1980, as amended, to reflect the creation of the additional RTC branch.
- Section 3 repeals and modifies all laws, rules, and regulations that are inconsistent with Republic Act No. 10247.
- Section 3 ensures that the existing statutory framework under Batas Pambansa Blg. 129 is aligned with the establishment of the new RTC branch in Sagay.
