Coverage: court creation and placement
- Section 1 creates four (4) additional branches of the Regional Trial Court to be stationed in San Pablo City, Province of Laguna.
- The created branches are placed within the Fourth Judicial Region.
- Section 1 directs that the Supreme Court shall assign the respective branch numbers of the newly created branches.
Supreme Court program and operationalization
- Section 2 requires the Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, to immediately include the operationalization of the four (4) additional branches in the Court’s program.
- Section 2 provides that the necessary funds for the operation of the newly created courts shall be appropriated and released only upon the actual organization of the court and the appointment of its personnel.
- Section 2 links operational readiness to actual organization and appointment of personnel, as conditions for release of appropriated funds.
Amendments, repeal, and consistency rule
- Section 3 amends Section 14(e) of Batas Pambansa Blg. 129 to the extent necessary for the creation of the four additional RTC branches.
- Section 3 provides that all other laws, rules and regulations inconsistent with Republic Act No. 11387 are amended, repealed, or modified accordingly.
- Section 3 makes inconsistency in any governing law or regulation subject to automatic amendment, repeal, or modification to align with the Act.
Definitions, policies, procedures, and sanctions
- The Act provides for creation and operationalization of additional RTC branches and for amendment of Section 14(e) of Batas Pambansa Blg. 129, but it does not establish separate definitions, procedural filing requirements, hearings, or compliance sanctions within its operative sections.
