Presidential Authority to Declare Additional Lands for NDC

  • The President is empowered to declare additional tracts of public domain lands as Government Reservations for NDC’s use in priority projects through executive proclamation.

  • Certified copies of such proclamations must be recorded in various government offices, including the Bureau of Forest Development, Bureau of Lands, Bureau of Mines, and Register of Deeds within 15 days.

Survey Procedures for Land Boundaries

  • Surveys necessary to establish metes and bounds may be conducted by the Bureau of Lands or any authorized person/entity approved by the Minister of Industry.
  • The Bureau of Lands must confirm the survey within 15 days of submission of survey returns.

Recording of Government Reservations and Capital Contribution

  • Lands declared as Government Reservations for the NDC’s projects must be recorded at their fair market value determined by a professional appraiser designated by the Minister of Industry.

  • All laws, decrees, executive orders, proclamations, instructions, rules, or regulations inconsistent with this Decree are repealed or modified accordingly.

Effectivity

  • The Decree took effect immediately upon issuance on January 11, 1981.
