Law Summary
Leadership and Composition
- The OSG is headed by the Solicitor General, acknowledged as the principal law officer and legal defender of the Government.
- The Solicitor General holds authority and responsibility for the mandate and operations of the Office, including supervision and control over all its constituent units.
- Appointment of the Solicitor General is by the President of the Philippines.
- The Solicitor General must meet the qualifications, rank, prerogatives, and privileges equivalent to those of the Presiding Justice of the Court of Appeals.
- The Solicitor General is assisted by a Legal Staff comprising fifteen (15) Assistant Solicitors General, various Solicitors, and Trial Attorneys as necessary.
- The Office is divided into fifteen (15) divisions, with flexibility for the Solicitor General to reassign personnel among divisions.
- Appointment of Assistant Solicitors General and Solicitors is by the President upon the Solicitor General’s recommendation.
- Trial Attorneys and administrative personnel are appointed directly by the Solicitor General.
Succession and Acting Appointments
- In cases of absence or temporary incapacity, the President designates an Acting Solicitor General.
- For death, permanent incapacity, removal, resignation, or vacancy, the President appoints an Acting Solicitor General or a new Solicitor General.
- The Acting Solicitor General serves until the appointment of a new Solicitor General.
Continuity of Current Incumbents
- All current officeholders shall continue their functions without requiring new appointments.
Appropriations and Funding
- Funds necessary for the operations of the OSG shall be sourced from its existing appropriations under the current General Appropriations Act.
Repeal and Modification of Inconsistent Laws
- All laws, orders, issuances, rules, and regulations, or parts thereof inconsistent with this Executive Order, are repealed or modified accordingly.
Effectivity
- This Executive Order takes effect immediately upon issuance, ensuring immediate organization and operational autonomy of the OSG.
