Definitions
- Conservation: Encompasses processes aimed at maintaining the cultural significance of Gabaldon school buildings, including preservation, restoration, reconstruction, protection, and adaptation.
- Gabaldon School Buildings: Refer to school buildings designed by American Architect William Parsons, funded under Act No. 1801 authored by Assemblyman Isauro Gabaldon.
Recognition as Cultural Properties
- Gabaldon school buildings are recognized as built heritage and classified as cultural properties under the National Cultural Heritage Act of 2009 (RA No. 10066).
- Public school teachers are exempt from liability for emergency repairs performed on these structures.
Conservation Program Implementation
- The Department of Education (DepEd) will lead conservation efforts in collaboration with the NCCA, NHCP, and National Museum.
- An inventory will be conducted to assess all Gabaldon school buildings nationwide for their physical status.
- School heads must report existence or damage of Gabaldon buildings to their Schools Division Superintendents.
- Local government units (LGUs) are required to adopt measures to protect Gabaldon school buildings within their jurisdictions and assist DepEd in conservation projects.
- Prohibition of any modification, alteration, destruction, demolition, or relocation of Gabaldon school buildings.
- DepEd and cultural agencies will provide technical assistance to maintain original architectural designs.
- Permitted modifications under NCCA permit may be allowed to address school expansion needs per the Enhanced Basic Education Act of 2013, while preserving the facade and distinct features.
Appropriations and Funding
- The Department of Education must include implementation funding for this Act in its current year program and appropriations.
- Ongoing funding will be included in the annual General Appropriations Act.
Rulemaking
- DepEd, in consultation with NCCA, NHCP, and National Museum, shall formulate implementing rules and regulations within 90 days of the Act’s approval.
Legal Provisions
- Separability Clause: Invalid or unconstitutional provisions do not affect the validity of the remaining provisions.
- Repealing Clause: Laws inconsistent with this Act are repealed or amended accordingly.
- Effectivity: The Act becomes effective 15 days after publication in the Official Gazette or a newspaper of general circulation.
