Effectivity and publication rule
- Section 5 provides that Republic Act No. 10156 takes effect fifteen (15) days following its publication in the Official Gazette or in at least two (2) national newspapers of general circulation.
- The publication-and-fifteen-days rule governs the start of enforceability.
Policy and purpose of eligibility conferment
- Republic Act No. 10156 confers civil service eligibility on covered LGU legislators who meet specified service and educational requirements.
- The eligibility conferred is intended to correspond to career service eligibility levels for appropriate appointment purposes.
Scope: who is covered
- Section 3 covers all members of the Sangguniang Bayan, Sangguniang Panlungsod, and Sangguniang Panlalawigan.
- Section 3 limits coverage to members elected after the effectivity of the Local Government Code of 1991.
Eligibility conferment: career professional level
- Section 1(a) confers an eligibility equivalent to a Career Service Professional Eligibility upon a covered member who has served for an aggregate period of nine (9) years in office.
- The covered member must be a holder of a bachelor’s degree.
- The eligibility granted under Section 1(a) is considered appropriate for second and first level positions in the career service respectively.
Eligibility conferment: career sub-professional level
- Section 1(b) grants an eligibility equivalent to a Career Service Sub-Professional Eligibility to a covered member who has served for an aggregate period of six (6) years in office.
- The covered member must have at least earned seventy-two (72) units in any baccalaureate degree program.
- The eligibility granted under this provision is considered appropriate for second and first level positions in the career service respectively.
Qualification limits and special eligibilities
- Section 1 provides that the eligibility conferred is except those positions which require qualifications in skills or trade test and/or require board examinations and other special eligibilities provided under special laws.
- The exception operates as a qualification limitation on appointment to specific positions with special examination/eligibility requirements.
Implementing rules and agencies
- Section 2(a) directs the Civil Service Commission (CSC) to promulgate the necessary rules and regulations to implement Republic Act No. 10156.
- The CSC must promulgate these rules in consultation with the Department of the Interior and Local Government (DILG).
- Section 2(a) requires promulgation within ninety (90) days after the effectivity of the Act.
Repealing clause
- Section 4(a) repeals or amends all laws, decrees, executive orders, rules and regulations, issuances, or parts thereof that are inconsistent with Republic Act No. 10156.
