Constitutional authority for deputation

- The President concurs in the deputation of law enforcement agencies.
- The President concurs in the deputation of other instrumentalities of the Government.
- All covered agencies are authorized to assist COMELEC in carrying out its election-related responsibilities for the covered recall election.
COMELEC coordination and duties of agencies
- The law enforcement agencies and concerned agencies must coordinate and cooperate with COMELEC in the performance of their duties and functions.
- The assistance is directed to support COMELEC in ensuring the elections are free, orderly, honest, peaceful, and credible.
Concurrence tied to COMELEC resolution
- The President’s concurrence is made in response to COMELEC Resolution No. 9948 (s. 2015), which resolved to request the President’s concurrence for deputation in connection with the covered recall elections.
- The election date for the covered recall elections is set by COMELEC en banc Resolution No. 15-0284 (dated 07 April 2015).
- The President’s concurrence expressly deputizes the AFP, PNP, law enforcement agencies, and other instrumentalities to assist COMELEC.
No separability or repealing clause
- The memorandum order directs execution through its immediate effectivity provision and does not include any separability, repealing, or sunset clause in its operative text.
