Emission Standards and Regulatory Framework
- DENR Administrative Order No. 04, series of 2015 sets emission limits (Euro 4 standards) applicable to new and used motor vehicles from July 1, 2015.
- Importation of used motor vehicles is generally prohibited except for certain vehicles compliant with current DENR emission standards.
- Accreditation of rebuilding centers ensures rebuilt trucks meet emission standards.
- Importation of secondhand motor vehicle engines is restricted unless they comply with emission standards under RA 8749 Section 23.
Certification Requirement for Importation of Used Motor Vehicles
- Importers must secure a Certificate of Authority to Import (CAI).
- Submission of a certification demonstrating compliance with Euro 4 emission standards (per DENR DAO 04 s. 2015) is required.
- Emission limits for different vehicle types are specified:
- CO levels at idling: ranges from 0.25% to 3.5% by volume depending on vehicle registration date.
- Hydrocarbon levels (HC) at idling: ranges from 100 ppm to 600 ppm based on registration date.
- Light Absorption Coefficient at free acceleration: ranges from 1.0 m-1 to 2.5 m-1 depending on registration date.
Importation of Used Vehicle Parts for Rebuilding Activities
- Only used parts and components compliant with Euro 4 emission standards are allowed for importation for truck rebuilding.
- Compliance must be certified by an authorized vehicle standards agency or manufacturer in the country of origin.
- Such certification must be authenticated by the Philippine Embassy or Commercial Attaché.
Objective and Enforcement
- The measures supplement Republic Act No. 8749 to ensure imported used motor vehicles and parts meet strict air pollution control standards.
- Implementation aims to improve air quality, public health, safety, and welfare by regulating motor vehicle emissions at the point of importation.
These provisions collectively establish a stringent regulatory framework to control emission pollution from imported used motor vehicles and related parts, reinforcing the Philippines' commitment to environmental protection under the Clean Air Act.
