Definition of "Filipinos Overseas"
- Defines "Filipinos Overseas" as permanent residents abroad.
- Includes Filipino emigrants who are citizens of foreign countries or pending naturalization.
- Encompasses descendants of these Filipinos, recognizing the extended diaspora.
Powers and Functions of the Commission
- Advises and assists the President and Batasang Pambansa on policies affecting Filipinos overseas.
- Formulates and coordinates integrated welfare programs in cooperation with relevant agencies.
- Monitors implementation of these welfare programs.
- Initiates and implements special projects to promote welfare related to Filipinos' interests in the Philippines.
- Acts as a forum to preserve and enhance social, economic, and cultural ties with the Philippines.
- Provides liaison services between Filipinos overseas and government or private agencies for business and ventures.
- Promulgates rules and regulations to fulfill its objectives.
- Can request assistance from government agencies and government-owned or controlled corporations.
- Performs additional functions as directed by the President or prescribed by law.
Organizational Structure and Overseas Presence
- Supported by a Secretariat organized as per Presidential Decree No. 1177.
- Authorized to establish offices abroad or appoint service attaches in embassies or consulates, subject to President's approval.
- May designate representatives from resident Filipinos overseas to assist its functions.
Compensation of Members and Personnel
- Ex-officio members receive per diems for meetings, capped at PHP 250 per meeting and PHP 1,000 per month.
- Other members, officials, and employees are compensated under Presidential Decrees No. 985 and 1285.
Abolition of the Office of Emigrant Affairs
- The Office of Emigrant Affairs under the Ministry of Labor and Employment is abolished.
- Its functions, funds, records, property, equipment, and personnel are transferred to the Commission.
Appropriations and Funding
- Appropriations previously allocated to the Office of Emigrant Affairs are used for the Commission's operational expenses for the current year.
- Additional funding can be drawn from the fund for organizational changes as per Batas Pambansa Blg. 40.
- Subsequent funding for the Commission shall be included in the General Appropriations Act.
Repealing Clause
- All inconsistent laws, orders, proclamations, rules, or regulations are repealed or modified accordingly to conform with this Act.
Effectivity
- The Act takes effect immediately upon its approval.
