Definition: “brand new unit”
- Brand new unit refers to a new motor vehicle constructed entirely from new parts.
- The motor vehicle must be submitted to the LTO for initial registration under Department Order No. 2010-032.
- A brand new unit whose initial registration with the LTO covers a three-year period is allowed for purposes of new CPC applications or substitution.
- Refurbished, rebuilt, reconditioned and rehabilitated units are not considered as brand new unit.
Allowed use for CPC and substitution
- Brand new units whose initial registration covers three years may be used in new applications for CPC.
- Brand new units may also be used as substitute units for phased out vehicles.
- An application for new CPC or substitutions using such brand new unit must be filed on or before the renewal of its registration.
- A brand new unit with year model 2012 and initial registration covering 2012, 2013 and 2014 may be used for a new CPC application or substitution if the application is filed on or before the renewal of its registration.
Provisional Authority for school transport service
- The LTFRB grants Provisional Authority to applicants for School Transport Service subject to the conditions stated in the circular.
- The circular requires that the applicant file the Provisional Authority application together with the School Transport Service application.
- The Provisional Authority application must include all documentary requirements, including a valid Parent-Teacher Association (PTA) or School Certification/Endorsement Letter.
- The applicant must submit Personal Passenger Accident Liability Insurance for each unit covered by the application.
Required fees and processing outcomes
- The applicant must pay the necessary fees for the request for provisional authority.
- After evaluation of the documents, an Order shall be issued by the Office where the application was filed.
- The Provisional Authority is valid for not more than THREE (3) months.
- The three-month period is counted from the date the application was filed.
Effect and limitation of Provisional Authority
- The grant of Provisional Authority does not automatically mean the granting of the Application for School Transport Service.
- Provisional Authority operates as a time-limited authorization and does not itself finalize approval of the underlying school transport service application.
Relationship to prior issuances
- The circular clarifies and modifies LTFRB Memorandum Circular No. 2013-006 (re: mandatory age limit for school transport service).
- All other issuances or parts inconsistent with the circular are modified, amended, or superseded accordingly.
