Legal basis and relationship to DAO 2000-28
- DENR Memorandum Circular No. 2000-21 operates in line with the rational implementation of DAO 2000-28 titled “Implementing Guidelines on Engineering Geological and Geohazard Assessment as Additional Requirements for ECC Applications Covering Subdivisions, Housing and Other Land Development and Infrastructure Projects.”
- The memorandum circular clarifies Section 1 of DAO 2000-28 on coverage.
- The memorandum circular clarifies Section 3.2 of DAO 2000-28 on qualifications.
- The memorandum circular instructs that guidelines shall be prepared by the Environmental Management Bureau (EMB) in consultation with the Mines and Geosciences Bureau (MGB).
Coverage: who must undergo assessment
- All private or government subdivision and housing projects must undergo Engineering Geological and Geohazard Assessment as an additional requirement for ECC applications.
- Other land development and infrastructure projects must also undergo Engineering Geological and Geohazard Assessment in connection with their ECC applications.
- Engineering Geological and Geohazard Assessment for land development and infrastructure projects applies when it is required by the Environmental Management Bureau (EMB).
- The assessment coverage for subdivisions and housing applies regardless of whether the project is private or government.
Qualification: who may undertake the assessment
- Engineering Geological and Geohazard Assessment must be undertaken by either a licenser professional Geologist or a licensed Engineer, as qualified below.
- A licenser professional Geologist must have a minimum of five (5) years of experience as a practicing geologist.
- A licensed Engineer must have at least five (5) years experience in land development and/or infrastructure development.
- A licensed Engineer must also have at least six (6) months training in Engineering Geology/Structural Geology or a post graduate diploma in Engineering Geology/Structural Geology.
Compliance monitoring responsibility and EGGAR
- Monitoring compliance with the recommendations in the Engineering Geological and Geohazard Assessment Report (EGGAR) is the responsibility of the concerned Local Government Unit (LGU).
- Monitoring compliance with the recommendations in the Engineering Geological and Geohazard Assessment Report (EGGAR) is also the responsibility of the EGGAR preparer.
- The obligation to ensure monitoring coverage is tied to the EGGAR and its recommendations.
Implementing guidelines for assessment
- EMB shall prepare guidelines for implementation.
- EMB must prepare these guidelines in consultation with MGB.
- The purpose of the guidelines is to operationalize the Engineering Geological and Geohazard Assessment requirement in relation to ECC applications for covered projects.
