Clarification on Filing Fees for Requests for Relief from Money or Property Accountability
- No filing fee shall be imposed on the initial request for relief from money or property accountability.
- Filing fees apply only when there is an appeal from the denial of such a request.
Amount and Basis of Filing Fee for Appeals
- The filing fee for appeals from denial of requests for relief from accountability is set at 1/10 of 1% (0.1%) of the amount of money lost or the acquisition cost of the lost property.
Liability for Payment of Filing Fees
- The filing fee for appeals shall be charged against the personal account of the Accountable Officer (AO).
- If an appeal arises from losses due to natural calamities without contributory negligence or misconduct by the AO, the filing fee may be charged to the agency.
- If the appeal under natural calamity losses is denied due to negligence on the part of the AO, the filing fee charged to the agency shall be refunded or reimbursed by the AO.
Application and Effectivity of the Resolution
- The Resolution applies to pending requests or appeals from denials of requests for relief from accountability.
- Payments of filing fees previously made shall not be refunded.
- The Resolution takes effect 15 days after its publication in a newspaper of general circulation.
