Purpose and training mission
- Section 2 requires the Iligan Institute of Technology to provide programs for effective manpower training needed for the industrial and commercial development of the Mindanao regions.
- Section 3 directs the establishment of an Advisory Council to ensure close coordination between the Institute’s training programs and the manpower needs of industry, business, and other sectors of the economy.
- Section 3 specifically links coordination to programs that will hasten the development of the Mindanao regions.
Advisory Council and its governance role
- Section 3 creates an Advisory Council charged to establish and promote close coordination between training programs and manpower needs.
- Section 4 requires that the Board of Regents determine the composition, including qualifications of members and their terms of office.
- Section 4 requires the composition to provide representation to varying, developing, expanding, and emerging industry, trade, and business, including Mindanao State University.
- Section 4 makes these officials ex-officio members:
- the Mayor of the City of Iligan,
- a representative of the City Council of Iligan, and
- the Director of Vocational Education or his representative.
- Section 5 requires the Secretary of the Board of Regents to issue notification whenever the agenda of the Board meeting includes items affecting the Iligan Institute of Technology.
Board of Regents representation rules
- Section 5 states that, for matters affecting the Iligan Institute of Technology, the Mayor of the City of Iligan, the Chairman of the Advisory Council, and the President of the Iligan Chamber of Industries are ex-officio members of the Board of Regents of the Mindanao State University.
- Section 5 grants those ex-officio members all rights and privileges of Board of Regents members.
- Section 5 limits their participation to matters within the interest and concern of the Iligan Institute of Technology, and it must not extend beyond that scope.
Funding and subsidy requirements
- Section 6 transfers the amount appropriated for the operation and maintenance of Lanao Technical School (Northern Mindanao Institute of Technology) in the annual General Appropriations Act for the fiscal year 1969 to the Iligan Institute of Technology for its operation and maintenance.
- Section 6 requires the government of the City of Iligan to allocate annually beginning fiscal year 1969, as part of its regular budget, a subsidy in a lump sum equal to 3% of its total gross income from all sources for the support and maintenance of the Institute.
- Section 6 requires that the total sums appropriated for the Institute by the National Government, by the Mindanao State University, and from other sources must aggregate not less than twice the City of Iligan subsidy.
- Section 6 provides that the City of Iligan subsidy, together with the annual contribution of the National Government, incomes from the operation of the Institute, and other funds secured from the National Government, are disbursed by the Board of Regents of the Mindanao State University in accordance with the purposes of the Act.
- Section 8 authorizes for appropriation beginning fiscal year 1969 and every fiscal year thereafter the sum of PHP 1,000,000 out of funds in the National Treasury not otherwise appropriated for the support of the Iligan Institute of Technology.
- Section 8 requires that PHP 1,000,000 be included in the Annual General Appropriations Act as a separate item in the government contribution to the Mindanao State University and disbursed by the Board of Regents in accordance with the purposes of the Act.
Abolition, transfer, and personnel protection
- Section 7 provides that, as a unit of the Mindanao State University, the Iligan Institute of Technology is governed by Republic Act No. 1387, as amended, the Charter of Mindanao State University.
- Section 7 vests administration of the Iligan Institute of Technology in the Board of Regents of the Mindanao State University, overriding conflicting provisions of law.
- Section 7 abolishes the Northern Mindanao Institute of Technology.
- Section 7 transfers to the Mindanao State University all personnel, unexpanded appropriations, properties, and other assets, whether in the name of the Northern Mindanao Institute of Technology or the Lanao Technical School.
- Section 7 protects transferred personnel by providing that nothing in the Act terminates their services or demotes them in rank and/or salary.
Effectivity
- Section 9 provides that Republic Act No. 5363 takes effect upon its approval.
- Approval date is June 15, 1968.
