Legal basis and implementing rule
- The memorandum circular is issued pursuant to Section 2, Rule XXXII of the Implementing Rules and Regulations of Republic Act No. 8749 (Clean Air Act of 1999).
- The implementing framework requires compliance with the emission standard rules under Rule XXXII for rebuilt and imported second hand completely built-up (CBU) vehicles.
- The emission standard for these vehicles is identified for use by reference to Table 18 of Section 2 Rule XXXII.
Purpose: CCES as registration prerequisite
- DOTC requires that all rebuilt and second hand imported completely built up (CBU) vehicles present a valid Certificate of Compliance to Emission Standard (CCES) before initial registration.
- No initial registration is allowed for covered vehicles unless the CCES is presented.
Coverage: rebuilt and imported second hand CBU vehicles
- Rebuilt vehicles are vehicles assembled in the country using either brand new or second hand engines and spare parts, including pre-registered vehicles retrofitted with brand new or second hand engines.
- Imported second hand CBU vehicles are used/second hand vehicles imported into the country.
- The CCES requirement applies to covered vehicles as a condition for initial registration with the LTO.
CCES form, source, and documentary basis
- The CCES must be in its original form.
- The CCES must be duly signed by the authorized signatory of DOTC.
- The CCES is issued based on a Motor Vehicle Inspection Report (MVIR) issued by existing government Motor Vehicle Inspection Stations (MVIS).
- The emission standard that must be followed in issuing and evaluating the CCES is the emission standard set forth in Table 18 of Section 2 Rule XXXII for rebuilt and imported second hand vehicles.
Emission standard adherence and LTO inspector duty
- The LTO inspector must ensure that the emission standards under item 3 of the implementing instructions are properly adhered to.
- The CCES issuance and compliance process is tied to the MVIR and to the Table 18 standards under Rule XXXII.
Prohibited act: allowing registration without conformity
- No DOTC or LTO employee may allow or cause the registration of a covered vehicle that is not in conformity with the emission standard referenced under the CCES implementation instructions.
- Initial registration of rebuilt and imported second hand CBU vehicles is prohibited without the presentation of a valid CCES.
Administrative liability and cancellation/revocation
- Any DOTC or LTO employee who allows or causes non-conforming vehicle registration is liable to administrative sanctions.
- The Certificate of Registration (CR) of the subject vehicle may be cancelled/revoked if the vehicle registration is allowed despite non-conformity with the required standards.
Dissemination and compliance directive
- The LTO is enjoined to disseminate the information to all regional and district offices.
- Compliance is enjoined for the concerned offices and personnel immediately upon effectivity of the memorandum circular.
