Constitutional and legal policy base
- Republic Act No. 11644 implements the State mandate to conserve, develop, promote, and popularize the nation’s historical and cultural heritage and resources (Section 2).
- Section 2 declares that all the country’s artistic and historic wealth constitutes the cultural treasure of the nation protected by the State.
- Section 2 directs that cultural treasures may be regulated in their disposition.
- Section 2 requires prioritizing promotion and preservation of Carcar City’s cultural and historical landmarks to support development and management of its tourism industry.
Heritage zone declaration for Carcar City
- Carcar City, Province of Cebu is declared a heritage zone under Article II, Section 3(q) of Republic Act No. 10066 (Section 3).
- Section 3 accords Carcar City priority development by the Department of Tourism (DOT).
- Section 3 requires coordination among the Provincial Government of Cebu, City Government of Carcar, the National Commission for Culture and the Arts (NCCA) and its affiliated cultural agencies, and other concerned government agencies.
- Section 3 subjects the heritage zone to the rules and regulations governing the conservation and preservation of heritage zones.
Tourism enhancement through heritage conservation
- The DOT, coordinated with the Provincial Government of Cebu, City Government of Carcar, NCCA and its affiliated cultural agencies, and the Department of Environment and Natural Resources (DENR) must prepare a development plan for Carcar City’s cultural and historical sites (Section 4).
- The development plan must involve preservation, conservation, restoration, and maintenance of cultural and historical sites and structures to enhance and sustain tourism in Carcar City (Section 4).
- The NCCA must approve only conservation and restoration methods and materials that strictly adhere to accepted international standards of conservation, using the standard framework in Section 15 of Republic Act No. 10066 (Section 4).
- The management of the protected area within Carcar City must apply the applicable provisions of Republic Act No. 7586 (as amended by Republic Act No. 11038) in coordination with the DENR (Section 4).
Required rules and implementation timeframe
- Within sixty (60) days from the effectivity of Republic Act No. 11644, the DOT, coordinated with the Provincial Government of Cebu, City Government of Carcar, NCCA and its affiliated cultural agencies, and the DENR, must promulgate the necessary rules and regulations for effective implementation (Section 5).
Effectivity and publication mechanism
- Section 6 makes the law effective 15 days after publication in the Official Gazette or a newspaper of general circulation.
- Republic Act No. 11644 contains no additional transitory implementation dates beyond the 15-day effectivity period and the 60-day rules issuance deadline (Sections 5 and 6).
