Policy and intent
- The Executive Order orders increased airplay of original Pilipino music to promote the growth of the local music industry.
- It relies on the constitutional duty of the State to conserve, promote, and popularize the nation’s historical and cultural heritage, as well as artistic creations and patronage to arts and letters.
Core requirement for radio stations
- Section 1 requires all radio stations that have musical format programs to broadcast a minimum of four (4) original Pilipino musical compositions in every clockhour.
- Section 1 ties the requirement specifically to every clockhour of a program with a musical format.
- For purposes of compliance, Section 1 defines “original Pilipino musical composition” as any musical composition created by a Filipino, with lyrics that may be in Pilipino, English, or any other language or dialect.
Definition used for compliance
- Section 1 recognizes an “original Pilipino musical composition” by the creator being Filipino.
- Section 1 allows the lyrics to be in Pilipino, English, or any other language or dialect, without changing the classification.
Non-compliance fines and suspensions
- Section 2 imposes a fine on any franchise holder or operator of a radio station that fails to broadcast the required minimum.
- The fine is PHP 100.00 per violation under Section 2.
- Section 2 authorizes the National Telecommunications Commission to, after due hearing, suspend or cancel the station’s Certificate of Registration and Authority to operate.
- Section 2 allows suspension or cancellation in cases of repeated violations of the Executive Order or its implementing rules and regulations.
Implementation by the NTC
- Section 3 directs the National Telecommunications Commission to promulgate the necessary rules and regulations to implement the Executive Order.
- Implementation rules must cover compliance and enforcement, consistent with the Executive Order’s requirement and penalties under Sections 1 and 2.
