Legal basis: inspection power under POEA rules
- Section 4 and 6, Rule IV, Book II of the POEA Rules and Regulations Governing Overseas Employment authorizes the Administration or its duly authorized representatives to inspect premises at any time depending on the purpose of inspections.
- The same rule authorizes the Administration to require the presentation of necessary documents, records, and books of accounts of the agency.
- The same rule authorizes the Administration to examine the presented accounts and records during inspections.
Required records for inspection
- Licensed recruitment agencies must keep their books of accounts and official receipts available for examination during POEA inspections.
- Licensed recruitment agencies must ensure their necessary documents, records, and books of accounts are presented when inspection requires them.
- Collection-related records must be organized so they can be reviewed during the inspection process.
Official receipts for every collection
- All collections made by an agency from each contract worker must be covered by an individual official receipt.
- Each official receipt must be issued at the time of payment.
- Each official receipt must clearly state the details of payments.
Consequences for noncompliance
- Failure of an agency to present its books of accounts and official receipts at the time of inspection results in the suspension of the license of the erring agency.
- Violations identified during examination of the books of accounts, official receipts, and other relevant records constitute a ground for the imposition of appropriate sanction.
- Violations identified during examination also constitute a ground for the denial of an application for renewal of license without further notice.
