Scope of Application
- Applies to all Bureau of Customs officials and employees regardless of employment status including permanent, temporary, casual, and co-terminous.
- Covers high-ranking officials including the Commissioner and Deputy Commissioner.
Signing and Acknowledgment of the Code
- The Interim Training and Development Division is tasked with briefing all Customs personnel on the Code.
- After the briefing, officials and employees must sign a certification confirming they have received, read, and understood the Code.
- The signed certification is to be filed in the personnel's 201 files for record-keeping.
Creation and Structure of the Grievance Committee
- A two-tier Grievance Committee is established under Sections 6 and 7 of the Code's Grievance Mechanism (Appendix C).
- Central Grievance Committee Composition:
- Chairperson: Deputy Commissioner, Internal Administration Group
- Members include Director of Administration Office, Chief of Ruling & Research Division, two representatives from the port/service of grievance origin, representatives from BOCEA and CURE Secretariat, and Chief plus designated staff from Human Resource Management Division.
- Local Grievance Committee Composition:
- Chairperson: District Collector of the concerned port
- Vice Chairperson: Deputy Collector for Administration
- Members include representatives from BOCEA/CURE, two rank and file representatives mutually chosen, a legal representative from the Law Division or Legal Service Secretariat, and administrative staff from the port.
Functions and Duties of the Grievance Committee
- Prevent grievances through pro-active activities like employee assemblies, counseling, and HR interventions; document proceedings for audits.
- Conduct continuous information campaigns on grievance mechanisms collaboratively with personnel units.
- Facilitate dialogue among involved parties to resolve issues.
- Investigate grievances and hold hearings within ten working days of receipt.
- Render decisions within five working days post-investigation.
- Ensure proper documentation of grievances, including written agreements on resolutions.
- Issue Certification on the Final Action on the Grievance (CFAG), summarizing the grievance history and final Bureau action.
- Submit quarterly reports on grievance resolutions and statuses to the Civil Service Commission.
- Develop internal procedures aligned with the Code of Conduct and relevant regulations to effectively perform its functions.
Effectivity Clause
- The BOC Function-Specific Code of Conduct takes effect immediately upon adoption on February 1, 2010, as signed by Commissioner Napoleon L. Morales.
