Establishment of the national high school
- A national high school is established in Barrio Binakayan, Municipality of Kawit, Province of Cavite.
- The school is established under the supervision of the Department of Education, Culture and Sports.
- The school is known as the Binakayan National High School.
- The establishment is expressly made as a national high school (not merely a local or secondary school).
Funding and General Appropriations Act
- The amount necessary to implement the Act must be included in the General Appropriations Act of the year following enactment into law.
- Funding inclusion continues in subsequent General Appropriations Acts “thereafter.”
- No separate appropriations or fixed amount is specified in the Act itself; the needed amount is addressed through the annual General Appropriations Act process.
Transitory effect and constitutional lapse rule
- The Act’s effectivity follows the rule that it takes effect upon approval.
- The Act became effective by lapse into law on February 27, 1998 without the President’s signature.
- The lapse rule is applied in accordance with Article VI, Section 27 (1) of the Constitution.
