Policy basis for port zoning
- Executive Order No. 143 recognizes that the PPA is mandated to establish, develop, regulate, manage, and operate a rationalized national port system in support of trade and national development.
- The order states that delineation and declaration of port zones under PPA aims to redirect and reorganize port administration for the full development of port districts.
- The order identifies the Port of Baybay in Baybay, Leyte as one of the major and busiest ports in the country.
- The order directs that the Baybay port zone must be defined to support planning and development of necessary port facilities responsive to regional shipping trade demands.
Port of Baybay delineation
- Section 1 delineates and establishes the territorial jurisdiction of the Port of Baybay situated in the City of Baybay, Province of Leyte.
- The Baybay port area is specifically described by boundary bearings and distances beginning at “point marked 1,” then proceeding through points 2, 3, 4, and 5, and returning to the point of beginning.
- The boundary description begins at point marked 1 being S. 26 deg. 00' W. 330 m. from BLLM No. 1, Baybay Cadastre.
- The total area covered is SEVEN HUNDRED THIRTEEN THOUSAND NINE HUNDRED SEVENTY-THREE (713,973) SQUARE METERS, more or less.
PPA administrative jurisdiction and planning duty
- Section 2 places the Baybay Port zone, as delineated in Section 1, under the administrative jurisdiction of the PPA.
- The PPA must implement a program for the proper zoning, planning, development, and utilization of the port.
- The PPA’s program must be consistent with regional industrial plans of the government.
Consistency, repeal, and amendment
- Section 3 repeals, amends, or modifies all issuances, orders, rules, and regulations, or parts thereof, that are inconsistent with Executive Order No. 143.
Separability and continued validity
- Section 4 provides that if any provision of Executive Order No. 143 is declared invalid or unconstitutional, the remaining provisions not affected remain valid and subsisting.
