Legal Bases
- Section 389(b)(9) of the Local Government Code of 1991 directs Punong Barangay to enforce laws on pollution control and environmental protection.
- Sections 6 and 7 of the Implementing Rules and Regulations (IRR) of R.A. 9003 provide for the creation and functions of Barangay Solid Waste Management Committees.
- Section 10 of R.A. 9003 requires segregation and collection of biodegradable, compostable, and reusable wastes at the barangay level.
- DILG Memorandum Circulars such as 2000-117, 2001-38, 2009-168, and 2011-70 reinforce zero-waste management, creation of ESWMC, and strict enforcement of R.A. 9003 provisions.
Purpose
- To inform and remind local officials and BESWMC members of their responsibilities.
- To harmonize existing issuances related to the BESWMC.
Scope and Coverage
- Applies to all City and Municipal Mayors, Punong Barangays, DILG Regional Directors, ARMM Regional Governor, and other concerned officials.
Organization and Composition of BESWMC
- The Punong Barangay shall issue an Executive Order organizing the BESWMC within 60 days after assuming office.
- Composition includes:
- Chairperson: Punong Barangay
- Members: One Sangguniang Barangay Member, SK Chairperson, President of Homeowners Association, Public/Private School Principal or Representative, PTA President or Representative, Religious Organization Representative, Bus Community Representative, Environmental NGO Representative, Market Vendors Association President, and Junkshop Owners Association Representative.
Functions and Responsibilities of BESWMC
- Formulate barangay-level solid waste management programs consistent with city/municipal plans.
- Oversee segregation and collection of biodegradable, compostable, and reusable wastes.
- Establish Material Recovery Facility (MRF), redemption or eco-centers in barangay-owned, leased, or suitable land.
- Allocate barangay funds for solid waste management, approved by the Sangguniang Barangay.
- Organize Area/Street Coordinators to assist in program implementation.
- Conduct training on segregation, composting, recycling, and waste-based livelihood opportunities.
- Integrate the solid waste management program into barangay development plans and investment programs.
- Seek alternative funding sources beyond regular barangay budgets.
- Submit monthly progress reports to city/municipal ESWMC and DILG office.
Policy Implementation Areas of BESWMC
- Education:
- Develop and disseminate IEC materials to households and institutions.
- Conduct community trainings on segregation, composting, waste reduction, and recycling.
- Issue community policies promoting eco-friendly products and packaging.
- Engineering:
- Support segregated collection mechanisms.
- Set up redemption or eco-centers (MRF) for recyclable materials before selling.
- Enforcement:
- Enact barangay ordinances establishing awards, incentives, sanctions, and implementation rules.
- Entrepreneurial:
- Establish buying and selling systems for recyclables and compost.
- Promote livelihood projects utilizing waste materials.
- Network with local private/business establishments.
- Provide microfinancing for waste-related livelihood initiatives.
Establishment of Barangay ESWM Secretariat
- A Secretariat shall be formed from community or Barangay Development Councils to provide technical and administrative support to BESWMC.
Functions and Responsibilities of the Punong Barangay
- Enforce R.A. 9003 and related Department issuances strictly.
- Establish and allocate land or cluster for MRFs.
- Initiate public consultations and information campaigns.
- Implement a comprehensive solid waste management system passed by ordinance.
- Coordinate with C/M Environment Natural Resources Officers or DENR for technical support and training.
Penalties for Non-Compliance
- Administrative sanctions under Section 50 of R.A. 9003 and the Ombudsman Law may be applied to officials failing to enforce rules.
- Section 52 allows any citizen to file civil, criminal, or administrative actions against public officers who neglect duties or abuse authority related to solid waste management, following a 30-day notice requirement.
- Actions may be filed with the DILG or Ombudsman for LGU-related violations.
Effectivity
- This memorandum circular takes effect immediately upon issuance.
