Conduct and Supervision of Plebiscite

  • The Commission on Elections (COMELEC) is mandated to conduct and supervise a plebiscite within 30 days from the law's effectivity.
  • The plebiscite is to be held in the affected area to ratify the creation of Barangay Banawa-Englis.

Election of Barangay Officials

  • A special election for the first set of barangay elective officials of Barangay Banawa-Englis must be conducted within 60 days after plebiscite ratification by majority vote.

Commencement of Corporate Existence

  • Barangay Banawa-Englis' corporate existence begins upon the election and qualification of its punong barangay and majority of the sangguniang barangay members.

Seat of Barangay Government

  • The seat of the Barangay Government shall be located at the old Sitio Banawa.

Internal Revenue Allotment (IRA) Shares

  • Barangay Banawa-Englis is entitled to IRA shares as per Section 285 of Republic Act No. 7160 (Local Government Code of 1991).

Appropriations for Plebiscite

  • Funding for the plebiscite will be charged against the Contingent Fund of the COMELEC.

Effectivity of the Act

  • The Act takes effect fifteen (15) days after complete publication in at least two newspapers of general and local circulation.
