Prohibition of active-gear fishing

Criminal penalties and liability

  • Violation of the prohibition subjects the boat captain and master fisherman to two (2) to six (6) years imprisonment.
  • The owner/operator is liable to a fine of two thousand (P2,000.00) pesos to twenty thousand (P20,000.00) pesos, in the discretion of the court.
  • If the owner/operator is a corporation, the penalty is imposed on the chief executive officer.
  • If the owner/operator is a partnership, the penalty is imposed on the managing partner.
  • The imposition of the penalty is without prejudice to the confiscation of the catch.

Repeal and inconsistency rule

  • All orders, rules, and regulations or parts thereof that are inconsistent with BFAR Administrative Order No. 201, s. 2000 are deemed repealed or modified accordingly.
