Commonwealth Act No. 223 authorizes the Secretary of Public Works and Communications to enter into contracts for the transportation of mails by air within or outside the Philippines, with a maximum duration of five years, and establishes the base rate of pay for these contracts.

Grant of Rights to Use Government Navigation Facilities

  • The Secretary is authorized to grant contract awardees the right to use all government navigation facilities necessary for airmail transport.
  • This includes all existing and future landing fields and other navigation aids controlled by the Philippine government or its subdivisions.

Rulemaking Authority

  • The Secretary, with the President's approval, may promulgate rules and regulations to enforce and implement this Act effectively.

Appropriation of Funds

  • An appropriation of PHP 150,000 is allocated for the year 1937 to implement the provisions of this Act.
  • Funds are to be disbursed by the Secretary of Public Works and Communications.
  • Unused funds revert to the general treasury at year-end.

Use of Additional Postage Revenue for Deficiencies

  • If annual appropriations are insufficient, the Secretary, with the President's approval, may utilize additional postage revenue from airmails for contractor payments.
  • The Secretary has discretion to determine the amount of additional revenue to be used.

Effectivity Provision

  • The Act takes effect on January 1, 1937.
