Creation and position of NICA
- A National Intelligence Coordinating Agency (NICA) is created to operate directly under the Office of the President.
- NICA is responsible and accountable only to the President of the Philippines.
- NICA is charged with coordinating all government activities relating to national intelligence.
- NICA must prepare intelligence estimates and intelligence summaries covering local and foreign situations and must make them available to the President and the President’s policy-making body.
Appointment of the Coordinator
- The President shall appoint a Coordinator of National Intelligence to head the National Intelligence Coordinating Agency.
- The Coordinator of National Intelligence serves as the leadership of NICA.
- The Coordinator of National Intelligence is required to keep the President advised of the findings of the Intelligence Consultative Committee.
Intelligence Consultative Committee
- An Intelligence Consultative Committee is established.
- The Committee is composed of:
- Coordinator of National Intelligence as Chairman;
- Chief, Military Intelligence Service, Armed Forces of the Philippines as Member;
- Chief, G-2, Philippine Constabulary as Member;
- Director, National Bureau of Investigation as Member;
- A representative of the Department of Foreign Affairs as Member;
- The Chief, Confidential Agents, Office of the President as Member.
- Representatives of other agencies concerned with national intelligence may be invited to attend meetings when matters affecting their respective agencies are involved.
- The Committee shall advise the Coordinator on:
- A. The general objectives of national intelligence;
- B. The allocation of collection responsibilities to the various agencies;
- C. The means of establishing and maintaining effective working relations between NICA and other intelligence agencies in furtherance of the national interest.
Powers and operational support
- The Coordinator of National Intelligence is authorized to call upon any department, bureau, office, agency, or instrumentality of the government for information and assistance required to perform the Coordinator’s functions.
- The Coordinator is empowered to request the detail to NICA of trained and qualified personnel from the Departments of Foreign Affairs, Interior, Justice, National Defense, Finance, Labor, or other departments, branches, or subdivisions of the national government as necessary for proper and efficient operation of NICA.
Effectivity and supersession
- Executive Order No. 235 supersedes Executive Order No. 167 (Series of 1948).
- The order takes effect immediately after issuance.
